Terms and Conditions
Honouring Legacy and Preserving Whakapapa
Kōhatu Memorials provides custom granite headstones, memorial engraving, and memorial installation services throughout Te Tai Tokerau and Northland. The following Terms & Conditions outline the agreement between Kōhatu Memorials and the Client for the design, manufacture, and installation of memorial stones in New Zealand.

1. Our Commitment

This agreement is entered into between Kōhatu Memorials (“we”) and the Client (“the whānau”).

We recognise that a memorial represents legacy and remembrance. We are committed to delivering workmanship with care, clarity, and professionalism throughout the design and installation process.

2. Agreement Basis & Variations

All quotations for granite headstones and memorial work are based on information provided at the time of pricing.

Any requested variations after acceptance may:

• Require a revised quotation
• Affect agreed timelines
• Incur additional costs

​Work on variations will not proceed until written approval is received.

3. Deposit & Payment

A 50% deposit confirms the order and allows production to begin.

The remaining balance is required before the memorial is installed or released.

Installation will not proceed until full payment has been received.

3(a) Late Payment

If any balance remains unpaid after the agreed due date, Kōhatu Memorials reserves the right to apply reasonable interest on overdue amounts and recover associated collection costs.

4. Production Timeframe

Estimated production time for custom granite memorials is approximately five (5) months from the date the deposit is received.

Delays outside our control may occur, including:

• Shipping delays
• Customs processing
• Quarry or supplier delays
• Port congestion
• Natural events

5. Engraving Approval

Before engraving begins, final artwork will be provided for approval.

The Client is responsible for carefully reviewing:

• Spelling
• Dates
• Imagery
• Layout
• All design details

Upon signing the Engraving Approval Form, all details are deemed correct and accepted.

6. Cancellation

If cancellation occurs prior to engraving approval, Kōhatu Memorials reserves the right to retain reasonable costs incurred, including design work, administration, and material procurement. Once engraving approval has been signed, the order becomes non-refundable.

7. Installation Warranty

Installation workmanship is warranted for twelve (12) months from the date of installation.

This warranty does not cover:

• Ground movement
• Soil subsidence
• Vandalism
• Accidental damage
• Events beyond our control

 

8. Installation & Responsibility

Where installation is included, it will comply with cemetery regulations and industry standards.

Responsibility transfers to the Client upon completion of installation.

Kōhatu Memorials is not liable for future movement caused by:

• Soil conditions
• Natural subsidence
• Weather events
• Third-party interference

 

9. Cemetery & Regulatory Compliance

Unless otherwise agreed in writing, the Client is responsible for obtaining all cemetery or council approvals for memorial installation.

Kōhatu Memorials is not responsible for delays caused by regulatory processes outside our control.

 

10. Intellectual Property

All designs, layouts, artwork, and engraving compositions created by Kōhatu Memorials remain our intellectual property unless otherwise agreed in writing. Designs may not be reproduced or supplied to third parties without written consent.

11. Ownership of Goods

All memorials remain the property of Kōhatu Memorials until full payment has been received. Ownership transfers only once all outstanding balances are paid.

12. Storage Fees

If installation or collection is delayed beyond the agreed timeframe, a storage fee of $40 per month will apply.

13. Limitation of Liability

To the extent permitted by New Zealand law, liability is limited to the value of the memorial supplied under this agreement.

Nothing in these terms limits rights under the Consumer Guarantees Act 1993 where applicable.

 

14. Governing Law

These terms are governed by the laws of New Zealand. Any disputes will first be addressed in good faith discussion before formal legal proceedings.

 

15. Marketing & Photography

Unless otherwise requested in writing, Kōhatu Memorials may respectfully photograph completed memorials for portfolio and promotional purposes.
